2015 Terms and Conditions
These conditions apply to all bookings accepted by Club Brilliant Day Ltd (“CBD”) unless otherwise agreed in writing. Your booking is not confirmed unless accepted by CBD and is also dependent on suite availability.
2. EVENT SPECIFICATION
CBD will supply the hospitality package or event management services as detailed (“the hospitality package"). The event specification may be varied with the CBD’s written agreement provided reasonable notice is given and subject to payment when demanded of any consequential price increase.
The total price payable for the hospitality package consists of
(i) A deposit of 50% of the total price payable with your booking, and which is non-refundable, and
(ii) Further payment of 50% of the total price payable 12 weeks prior to the event.
Your booking will not be confirmed by the CBD until the deposit has been paid.
Prices are stated inclusive of Value Added Tax unless otherwise shown.
If the event package price DOES NOT include a drinks allowance, drinks will be charged as consumed at the event. For drinks on consumption, a deposit will be payable in advance, drinks stock will be signed in and out by CBD’s Suite Manager each day and a detailed drinks bill will be submitted with an invoice for payment within 14 days. Any excess on the deposit will be repaid.
Any extras requested at the event by your event representative (subject to availability) will be charged at cost plus 15% and be payable not later than fourteen days after the event subject only to prior submission of our invoice.
If a catering order cannot be submitted to Silverstone until within 14 days of the event date, a 25% surcharge will be charged on the catering element. This reflects the charge made by the caterer to CBD.
The deposit and the further payment must be paid in full (in cash or cleared funds) by the due date or dates indicated overleaf. If not, CBD reserves the right to cancel your booking by giving you written notice at any time after the due date for payment.
CBD reserves the right to charge you interest on all outstanding amounts at the rate of 8% per annum above Barclays Bank Plc prevailing base rate until paid in full (a part of a month being treated as a full month for the purpose of calculating interest).
This clause applies if CBD cancels your booking under paragraph 4 or if you cancel your booking at any time.
If the booking is cancelled after the due date for payment, you are nevertheless liable to pay the further payment immediately.
Following the cancellation of your booking, CBD will use all reasonable endeavours to re-sell the hospitality package at the best price reasonably obtainable, to another customer. If successful in doing so CBD will repay you all or part of the second payment subject to a deduction from the total price of CBD’s loss of bargain and any expenses of re-sale.
If you shall make default in or commit a breach of the Contract or any other of your obligations to CBD, CBD shall have the right forthwith to determine any contract then subsisting.
6. THE EVENT
These terms and conditions take precedence over any printed on client purchase orders or letters of acceptance.
CBD does not accept responsibility for any changes to the event programme including without limitation the cancellation of the event or the general arrangements made by the event organisers.
CBD will not be liable for any delay in performing its obligations as a result of fire, flood or similar natural disaster, strikes, industrial disputes, inclement weather, war, acts or threats of terrorism, governmental order or decrees or any other cause beyond its reasonable control.
CBD and the event organisers are unable to offer refunds or exchanges in respect of hospitality places purchased unless the event is cancelled due to circumstance(s) for which the event organisers are covered by their relevant insurance and as such are able to offer CBD or its customer(s) compensation. Tickets are not transferable to other events and are strictly not to be offered for resale. No ticket for the Event shall be sold or offered for sale for any form of fee or reward without the prior written consent of CBD. Tickets must only be used for personal or private use. Tickets supplied by CBD for any event shall not be used by any person for either advertising, promotional or commercial purposes including without limitation, prizes, competitions, contests or sweepstakes without the prior written consent of CBD first being obtained. If this ticket is resold or transferred for profit or for commercial benefit or gain (including as part of a promotion or prize) or as part of any hospitality package or similar arrangement by anyone without CBD authority it will become void and the holder may be refused entry to or ejected from the Event and/or the Venue. Ticket holders agree to fully indemnify CBD for all costs and expenses (including legal expenses) incurred as a direct or indirect result of all and any claims howsoever arising from any third parties as a result of the contravention of this term.
You are responsible for the conduct and behaviour of your guests at our hospitality suite. Your guests will be required to comply with circuit regulations and any directions of circuit staff and stewards on the day. If they do not, they may be asked to leave by the meeting’s organisers and CBD accepts no responsibility. The Circuit reserves the right to refuse admission.
Drinks provided by CBD must be consumed at the suite and may not be taken away.
It is your responsibility to ensure that your event representative is in attendance throughout the event. Your event representative counts as one of your guest places unless we agree other arrangements beforehand.
Full day guest places are not transferable.
Visitors who are not paid guests will only be admitted at CBD’s discretion. CBD reserves the right to charge the additional guest fee regardless of the time of entry, payable as per other extras, or to ask them to leave at any time after admission.
Damage or loss of fixtures and fittings as a result of actions of your guests, contractors or staff during set-up, the event day or clear-down may be charged as extras.
CBD operates a sensible drinks policy in line with Silverstone's best practice.
CBD and the circuit reserve the right to alter your seat/suite location (if any) without prior notice. If this is necessary for any reason, CBD will reimburse any reduction in value between the original and altered seat/suite allocation. Seats for the Wellington grandstand are not reserved.
CBD reserves the right to refuse admission and to remove persons from the Venue who do not comply with the Venue rules or these terms and conditions, who represents a security risk, nuisance or annoyance to the staging of the Event or who have in his or her possession prohibited items, which shall include but not be limited to alcoholic beverages, chemicals of any kind, glass bottles, barbeques, ladders, laser pens, weapons or any offensive materials in whatever format.
Motor racing is dangerous and noisy. CBD, the circuit and the Sanctioning bodies (the organisers of the Event (including officials, marshals, rescue medical staff), competitors and drivers, are not responsible for any loss or damage howsoever caused, to you to the maximum extent permitted by law (except in the case of death or personal injury caused by negligence of the above parties).
attending the Event acknowledge that they may be
exposed to possible risk of physical harm due to
the nature of the Event. Neither CBD or the
circuit will be liable for any loss, injury or
damage, howsoever caused, to you or your property
(“Loss”) except where and only to the extent that
any such Loss is caused by the negligence of CBD,
the circuits, their employees or authorised
agents. Without prejudice to the foregoing, CBD
and the circuit excludes to the maximum extent
permitted by law any liability for such Loss. Any
liability on the part of CBD and the circuits
shall be limited to the face value of the relevant
ticket and any booking fee.
